1. Agreement to Terms

By accessing and using the NaturalNesting website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on NaturalNesting's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modifying or copying the materials;
  • Using the materials for any commercial purpose or for any public display (commercial or non-commercial);
  • Attempting to decompile or reverse engineer any software contained on NaturalNesting's website;
  • Removing any copyright or other proprietary notations from the materials;
  • Transferring the materials to another person or "mirroring" the materials on any other server;
  • Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the website;
  • Using any robot, spider, scraper or other automated means to access the site;
  • Circumventing or bypassing any security or technological measure in place.

The materials on NaturalNesting's website are provided on an 'as is' basis. NaturalNesting makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations of Liability

In no event shall NaturalNesting or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on NaturalNesting's website, even if NaturalNesting or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on NaturalNesting's website could include technical, typographical, or photographic errors. NaturalNesting does not warrant that any of the materials on its website are accurate, complete, or current. NaturalNesting may make changes to the materials contained on its website at any time without notice.

6. Design Services Terms

6.1 Service Agreement

When you engage NaturalNesting for design services, you are entering into a service agreement. A detailed scope of work, timeline, and pricing will be provided and must be agreed upon in writing before work commences.

6.2 Payment Terms

  • A deposit of 50% is required to confirm the project booking.
  • The remaining balance is due upon project completion.
  • Invoices are due within 30 days of receipt.
  • Late payment may result in a 1.5% monthly interest charge.

6.3 Cancellation and Refunds

  • Cancellations made more than 30 days before the scheduled start date will receive a full refund of deposits.
  • Cancellations made within 30 days will forfeit the entire deposit.
  • Cancellations made after work has commenced will be charged based on work completed.

6.4 Design Revisions

The agreed-upon service package includes a limited number of design revisions. Additional revisions beyond the scope of work will be charged at our current hourly rate.

7. Intellectual Property Rights

All design work, concepts, materials, and content created by NaturalNesting for client projects remain the intellectual property of NaturalNesting until full payment is received. Upon full payment, ownership of the final design work is transferred to the client. However, NaturalNesting retains the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.

8. User-Generated Content

If you submit any content, including but not limited to comments, feedback, ideas, or suggestions regarding our services, you grant NaturalNesting the non-exclusive right to use, reproduce, modify, and distribute such content without compensation or attribution.

9. External Links

NaturalNesting is not responsible for the contents of any external linked website. The inclusion of any link does not imply endorsement by NaturalNesting of the site. Use of any such linked website is at the user's own risk.

10. Limitations on Services

Design recommendations are based on professional expertise and industry standards. NaturalNesting does not guarantee specific results from design services. Results may vary based on individual preferences, spatial constraints, and external factors beyond NaturalNesting's control.

11. User Conduct

You agree not to use the NaturalNesting website or services for any purpose that is unlawful or prohibited by these terms, including but not limited to:

  • Harassment, threats, or abusive language;
  • Infringement of intellectual property rights;
  • Transmission of viruses or malicious code;
  • Fraudulent or deceptive activities;
  • Violation of any applicable law or regulation.

12. Indemnification

You agree to indemnify and hold harmless NaturalNesting, its officers, directors, and employees from any claim, liability, loss, or expense (including reasonable attorney's fees) arising out of your use of the website or violation of these terms and conditions.

13. Governing Law

This agreement and the use of this site is governed by the laws of the State of Oregon, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Multnomah County, Oregon for resolution of any disputes.

14. Modifications to Terms

NaturalNesting reserves the right to modify these terms and conditions at any time. Changes become effective immediately upon posting. Your continued use of the website signifies your acceptance of these changes.

15. Termination

NaturalNesting may terminate or suspend your access to its website and services immediately, without notice or liability, for any reason whatsoever, including if you breach these Terms and Conditions.

16. Severability

If any provision of these terms is found to be unlawful, void, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if that's not possible, it will be severed, and the remaining provisions will remain in full force and effect.
